  • Tips for Dealing with Car Accident Settlements

    Being involved in a car crash can be a pain – literally.  If you’ve been in a wreck, soon you will be involved in negotiations with the insurance company to determine the amount that your settlement will be.  A negotiated settlement benefits both sides because both you and the insurance company avoid lengthy and costly legal proceedings.  But, insurances companies have years of experience in dealing with settlements, giving them the upper hand.  If you want to have a little more leverage with the insurance company, follow these general tips.

    First, don’t agree to any settlement offered immediately after your accident.  No two car crashes are alike and neither will any two settlements.  Take your time and make sure that you have all the proper research done   Laws differ from state to state, but in most state you will have at least a year before you have to file charges to move your accident claim forward.  Use this time to put together your case and negotiate with the company.

    When you submit a counter offer to the company, make sure that it is well-researched and supported, especially if you are sending in an auto accident settlement letter.  Any settlement letter that you submit should include all of your expenses itemized out in the greatest amount of detail possible and any applicable receipts that prove these damages were indeed what you paid.  By supporting your claim strongly, it makes it look like you know what you are doing, that your offer is legitimate, and that you won’t be making huge concessions.

    Finally, if your settlement is for a large amount, you should consider enlisting the help of a lawyer.  They can charge large fees, up to about one-third of the settlement in some cases, and might not be worth the price in more straightforward cases, but if your case involves significant personal injury, they can make sure that your right are protected.
